On the flip side, many employees are indeed misclassified as independent contractors. The test is simple: does the worker have other clients, set their own hours, and provide their own tools? If not, they are employees.

As a massage therapist, many therapeutic massage clinics classify their employees as contractors despite obviously failing that test.

My best friend worked as a social worker in homes, 40+ hours a week, and the misclassification cost him tens of thousands of dollars during the course of many years.
